General information

Orders only become binding after confirmation. Declarations made by telephone also require written confirmation.

Pricing

Unless otherwise agreed, prices are ex works, including packaging. The applicable rate of VAT will be added separately.

Delivery time

Delivery dates are non-binding. We reserve the right to deliver subject to correct and timely delivery by our suppliers.

Notice of default, covering purchases or claims for compensation are excluded.

Shipping

Unless otherwise agreed, dispatch shall be at the expense and risk of the recipient.

Complaints

Complaints can only be considered within 8 days of receipt of the goods, after which the consignment is deemed to have been accepted without reservation. For items that are proven to have material or manufacturing defects that preclude their use, we will provide a replacement - after returning the goods free of charge for us. The buyer (ordering party) shall not be entitled to any further claims, in particular claims for damages.

Missing packages or transport damage must be acknowledged by the delivering carrier and reported within 48 hours.

Payment terms

Payments must be made within 8 days of the invoice date in cash with a 2% discount or within 30 days net. Agreements deviating from this require written confirmation. If payment is overdue, default interest of 5% above the bank discount rate will be charged. Bills of exchange will only be accepted in payment after prior written agreement. Discount charges shall be borne by the exhibitor. If bills of exchange and checks given in payment are not honored, all our claims shall become due. In the event of unfavorable information about the buyer, we are entitled to demand advance payment or to withdraw from the contract.

Legal provisions

Retention of title

As long as the delivered goods have not been paid in full, including the redemption of bills of exchange given in payment, the goods remain our property. This retention of title shall also apply in the event of resale by our customer to his buyer. We hereby expressly emphasize this extended retention of title.

Place of performance/jurisdiction

The place of performance/jurisdiction for deliveries and payments is Rheine.
